01 Privacy Policy

AltioraxDynamics ("the Controller"), registered at Calle García Luna 24, Piso 3 B, Madrid, Spain, is committed to protecting the privacy and personal data of all visitors and clients in accordance with the European Union General Data Protection Regulation (EU GDPR) 2016/679 and the Spanish Organic Law 3/2018 on the Protection of Personal Data (LOPDGDD).

4. Legal Basis for Processing

We process personal data under the following legal bases as defined in Article 6(1) of the EU GDPR:

  • Contractual Necessity (Art. 6(1)(b)): When processing is required to perform a service agreement
  • Legitimate Interest (Art. 6(1)(f)): For platform security, abuse prevention, and service improvement
  • Legal Obligation (Art. 6(1)(c)): For tax record retention and regulatory compliance

5. Data Retention

Personal data is retained only for the duration necessary to fulfill the purposes outlined in this policy. Contact form submissions are retained for a maximum of 24 months. Contract-related data is retained for the duration of the agreement plus 6 years, in compliance with Spanish commercial and tax record-keeping obligations. Server logs are automatically purged after 90 days.

6. Data Sharing

AltioraxDynamics does not sell, rent, or trade personal data. Data may be shared with the following categories of processors solely as necessary:

  • Hosting infrastructure providers (data processed within the EU/EEA)
  • Payment processing services (Stripe) for transaction-related data
  • Email delivery services for transactional communications
  • Legal and tax advisors upon legal obligation

All third-party processors are bound by Data Processing Agreements (DPAs) ensuring GDPR-compliant handling of personal data.

7. International Transfers

AltioraxDynamics does not transfer personal data outside the European Economic Area (EEA) unless adequate safeguards are in place, including Standard Contractual Clauses (SCCs) as approved by the European Commission, or the destination country has received an adequacy decision under Article 45 of the EU GDPR.

8. Your Rights

Under the EU GDPR, you have the following rights regarding your personal data:

  • Right of Access (Art. 15): Request a copy of all personal data we hold about you
  • Right to Rectification (Art. 16): Request correction of inaccurate or incomplete data
  • Right to Erasure (Art. 17): Request deletion of your personal data ("right to be forgotten")

9. Data Security

AltioraxDynamics implements appropriate technical and organizational measures to protect personal data, including TLS/SSL encryption, access controls, regular security audits, and encrypted data storage. In the event of a personal data breach that poses a high risk to your rights and freedoms, we will notify the relevant supervisory authority within 72 hours and inform affected individuals without undue delay, in compliance with Articles 33 and 34 of the EU GDPR.

10. Supervisory Authority

If you believe your data protection rights have been infringed, you have the right to lodge a complaint with the Spanish Data Protection Authority (Agencia Española de Protección de Datos — AEPD) at www.aepd.es.

03 Refund Policy

Effective Date: 1 January 2026

AltioraxDynamics, operating from Calle García Luna 24, Piso 3 B, Madrid, Spain, provides the following refund terms governing all service engagements.

1. Deposit and Initial Payments

All projects require a non-refundable deposit of 30% of the total project value upon agreement confirmation. This deposit secures project scheduling and initiates the architecture and discovery phase. The deposit is non-refundable once work has commenced.

2. Milestone-Based Billing

Projects exceeding 1,500€ are billed in milestone installments. Refund eligibility for completed milestones is assessed as follows:

  • Milestones fully completed and delivered: non-refundable
  • Milestones in progress at the time of cancellation: 50% of the milestone fee is refundable
  • Milestones not yet initiated: fully refundable

3. Cancellation by Client

Clients may cancel a project at any time by providing written notice to [email protected]. Upon cancellation:

  • All completed and approved work up to the cancellation date is payable in full
  • All source code, design files, and deliverables for paid milestones are transferred to the client
  • Unused prepaid amounts for non-initiated work will be refunded within 14 business days

4. Cancellation by AltioraxDynamics

AltioraxDynamics reserves the right to terminate a project if the client fails to provide required materials, feedback, or responses for more than 30 consecutive days. In such cases, all completed work is delivered and all outstanding invoices become due. No refund is issued for work already completed.

5. Subscription Services

For ongoing subscription-based services (hosting, maintenance, support retainers), refunds are calculated on a pro-rata basis for the unused portion of the current billing period. Annual subscriptions may be cancelled with 30 days written notice, with a refund for the remaining months minus a 10% administrative fee.

6. Refund Processing

All approved refunds are processed within 14 business days via the original payment method. Stripe-processed payments are refunded through the Stripe dashboard. Bank transfer refunds require valid account details provided by the client.

7. Dispute Resolution

In the event of a billing dispute, clients should contact [email protected] within 30 days of the disputed charge. AltioraxDynamics commits to resolving disputes amicably within 14 business days. Unresolved disputes may be escalated to the relevant consumer protection authority in Spain.

04 Terms of Service

Effective Date: 1 January 2026

These Terms of Service ("Terms") govern all services provided by AltioraxDynamics, registered at Calle García Luna 24, Piso 3 B, Madrid, Spain, to its clients ("the Client"). By engaging our services, the Client agrees to be bound by these Terms.

1. Scope of Services

AltioraxDynamics provides web development, platform architecture, community system design, and related digital services as specified in individual project proposals and statements of work. Each project's scope, deliverables, timeline, and pricing are defined in a written agreement or proposal signed by both parties prior to commencement.

2. Project Proposals and Acceptance

Project proposals remain valid for 30 days from the date of issue. Acceptance of a proposal constitutes a binding agreement. Any modifications to scope, timeline, or pricing must be documented in a written change order agreed upon by both parties.

3. Client Obligations

The Client is responsible for providing timely access to required resources, including hosting accounts, domain credentials, content, brand assets, and feedback on deliverables. Delays in Client-provided materials will result in corresponding adjustments to the project timeline. AltioraxDynamics is not liable for schedule impacts caused by Client-side delays.

4. Intellectual Property

Upon full payment, all deliverables — including source code, design files, and documentation — are transferred to the Client in full. AltioraxDynamics retains the right to display completed projects in its portfolio and marketing materials unless the Client explicitly requests otherwise in writing. Third-party libraries, frameworks, and tools used in development remain subject to their respective open-source or commercial licenses.

5. Payment Terms

Invoices are payable within 14 days of issue unless otherwise specified. Late payments incur a statutory interest rate of 8% per annum plus a fixed recovery fee of 40€, in accordance with EU Directive 2011/7/EU on late payments in commercial transactions. AltioraxDynamics reserves the right to suspend work on any project with outstanding invoices exceeding 21 days.

6. Warranties and Limitations

AltioraxDynamics warrants that all deliverables will conform to the specifications outlined in the accepted proposal for a period of 30 days following final delivery ("Warranty Period"). During this period, defects directly attributable to non-compliance with specifications will be corrected at no additional cost. AltioraxDynamics does not warrant against defects arising from Client modifications, third-party integrations, or changes in external platform APIs.

7. Limitation of Liability

To the maximum extent permitted by applicable law, AltioraxDynamics' total aggregate liability under any agreement shall not exceed the total fees paid by the Client for the specific project giving rise to the claim. AltioraxDynamics shall not be liable for indirect, incidental, consequential, or punitive damages, including loss of revenue, data, or business opportunity.

8. Confidentiality

Both parties agree to maintain the confidentiality of proprietary information exchanged during the course of a project. This obligation survives the termination of the agreement for a period of 24 months. Confidential information shall not be disclosed to third parties without prior written consent.

9. Force Majeure

Neither party shall be liable for delays or failures in performance resulting from causes beyond reasonable control, including but not limited to natural disasters, acts of government, power failures, internet outages, or cyberattacks. The affected party shall notify the other party within 72 hours of becoming aware of such an event.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of Spain and the European Union. Any disputes arising from or related to these Terms shall be submitted to the exclusive jurisdiction of the courts of Madrid, Spain. Both parties agree to attempt amicable resolution of disputes before initiating formal legal proceedings.

11. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
